  43. READ THIS LICENSE AGREEMENT CAREFULLY BEFORE USING THIS PRODUCT. BY USING THIS PRODUCT 
  44. YOU INDICATE YOUR ACCEPTANCE OF THE TERMS OF THE FOLLOWING AGREEMENT. THESE TERMS 
  45. APPLY TO YOU AND ANY SUBSEQUENT LICENSEE OF THIS PRODUCT. IF YOU DO NOT ACCEPT OR 
  46. AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT USE THIS PRODUCT. IF YOU DO USE THIS 
  47. PRODUCT THEN YOU AGREE TO ALL THE TERMS OF THQ INC. ("LICENSOR").

  49. Licensor retains the ownership of this copy and any subsequent copies of the Product. 
  50. This copy is licensed to you for use under the following conditions:

  52. Permitted Uses.
  53. You may: use the Product on any supported computer configuration and permanently 
  54. transfer the Product and its documentation to another user provided the recipient 
  55. agrees to the terms of this Agreement.

  57. Prohibited Uses.
  58. You may not: sell, transfer, distribute, rent, sub-license, or lease the Product or 
  59. documentation for profit; decompile, disassemble, or reverse engineer the Product or 
  60. documentation, or portions thereof; export the Product in violation of any United 
  61. States export laws.

  64. LICENSOR MAKES NO WARRANTY OR REPRESENTATION, EITHER EXPRESS OR IMPLIED, WITH RESPECT 
  65. TO THE PRODUCT, INCLUDING ITS QUALITY, PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR 
  66. A PARTICULAR PURPOSE. IN NO EVENT WILL LICENSOR BE LIABLE FOR DIRECT, INDIRECT, 
  67. SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO 
  68. USE THE PRODUCT OR DOCUMENTATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 
  69. IN NO CASE SHALL LICENSOR'S LIABILITY EXCEED THE AMOUNT OF THE LICENSE FEE PAID, IF 
  70. ANY. THE WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL 
  71. OTHERS, ORAL OR WRITTEN, EXPRESS OR IMPLIED. Some states do not allow the exclusion 
  72. or limitation of implied warranties or limitation of liability for incidental or 
  73. consequential damages, so that the above limitation or exclusion may not apply to you.

  76. Licensor retains all rights not expressly granted herein. Nothing in this License 
  77. Agreement constitutes a waiver of Licensor's rights under United States copyright law. 
  78. This license is non-exclusive. This license and your right to use the Product 
  79. automatically terminate without notice from Licensor if you fail to comply with any 
  80. provision of this License Agreement, or any terms and conditions associated with the 
  81. sale of this Product. Upon termination, you will destroy all documentation, disks, 
  82. or erase or destroy all code. This Agreement is governed by the laws of the State of 
  83. Oregon and the United States.
